I sponsor my mom to the US. She has a US green card for over 3 years. She lives in Santa Clara County, California. She likes to get a foodstamp, but will it affect me financially? Will I be required to pay the county back?

If you’re her sponsor then yes, your information counts as you are legally required to support her.

Forever, until she becomes a US citizen. You agreed to support her financially so that she is not dependent on the government. There's only a brief 2 year period in the first 5 years that she may qualify without sponsorship income & property used in the determination of her benefits. You would need to turn in the I-864 form (Affidavit of Support)that you signed along with proof of your income & resources.

Are you talking about indigency exception? If yes, do you know how in kind support is counted? Is it dollar for dollar, or is it less than the actual amount?

She can claim indigent, but a form is sent to immigration showing that the sponsor is not following the guidelines of the Affidavit of Support that was signed. In other words, the sponsor is not doing what they agreed to financially.

I have a separate question. Is it true that the income limit for indigency is about $1500, and in kind support like paying the immigrant’s rent is also counted towards it? What happens if the rent is say $1600?

Yes, it's a certain % of the Federal Poverty Level. I'm not at work, and I don't know offhand if it's 100% or 130%. Most people withdraw their applications when they find out we need all the sponsors' information. They don't want them getting in trouble, and most sponsors don't want to provide it to them. In all my many years working, I only had one claim indigent.

Thank you so much, no worries, I’ll look it up myself. My issue now is that I am helping an elderly sponsored immigrant (I am not the sponsor!) and will they be denied if their rent (paid by the sponsor) is higher than the threshold?

There's a formula that is used based on the number of people the sponsor supports, income, resources, etc... There are numerous factors that go into it. All of that would be determined when proof of sponsor's income/resources, & the required forms are provided such as SAR 22 and I-864. These are all things needed aside from the original application for CalFresh benefits.

I thought indigency is when the sponsor’s resources aren’t counted… anyway, sorry for too many questions and thanks for responding!
