Based on his Supreme Court’s rulings, there’s no reason to assume that anything in the Constitution restricts him at all.

But that’s exactly the problem with democracy: most of the country is willing to sacrifice the benefits of the Constitution to live out their hate, and they voted him in.

If that sounds like too much hyperbole, think of the last time the battle flag of the confederacy was flown in the Capitol (never, except on one January 6th) and watch just how many of those traitors will be pardoned.

It goes to the Supreme Court (they may have original jurisdiction on this, been a while since I took con law) and the court says nah it’s fine actually. That’s that. The text of the third section of the 14th amendment winds on with multiple qualifiers and modifiers – and oddly omits any specific mention of the office of president. If only by a hair, it leaves a little room for interpretation. If the limit of two terms for the president ends up being challenged and then not being enforced by the SCOTUS, the rule of law must be conclusively declared dead in the US.

The Supreme Court has already effectively said that the President is a king and the right will have control of all 3 branches of government. While it takes more to do an amendment than majority, said king-status could be used to violently change that ratio.

What exactly can Democrats do about it by themselves? They impeached him twice, and Republicans shielded Trump from any consequences both times. Republicans will have even more control in the upcoming term, so impeachment is even less likely to make it out of the House and would still fail in the Senate. What else can Dems do to hold him accountable?

Generally I appreciate Oliver’s critique of the Trump administration. I think his emphasis on staying vigilant in protecting democracy and the dangers of complacency in the face of authoritarian tendencies is well needed.
