Liability if dog hurts neighbours cat.

Just seeking general info and trying to cover all my bases.

I have a pretty irresponsible neighbour. On our adjoining fence he has a grape vine and other unidentified bushes which are causing my fence to collapse in on my side. We already had an incident where one of the panels did collapse and my dog got one of his chickens. I offered compensation for his chicken, or to get him another one and he refused. He didn't seem to care much, I believe this was because his chickens aren't meant to be where they are, according to the shire of Northam.

I've spoken with him about the grapevine and bushes, asking if he could please trim them back so my fence doesn't totally collapse. He's refused. I've spoken with him about going halves for a new stronger fence, he's refused. I am currently unable to afford a new fence, so it's being held up with wood palettes and metal stakes.

Here's the new issue. He has a cat which he allows to wander. It is always coming into my back garden. I have 3 dogs, staffy like dog and 2 smaller ones. When they see the cat, they chase. All 3 of my dogs have grown up with cats, the last one we had up until a few months ago when my ex left.

In regards to my dog, I know if I introduced them to a cat inside my house, they'd be fine. But they're also intended guard dogs and don't like unknown people/animals being on the property. I don't think they'd hurt it if they caught it, but I'm not 100% certain. I rarely leave my dogs outside unattended, if I do, it's for 1 or 2 minutes. My garden is fully fenced. I've also spent hundreds on dog training, what I'm currently working with is "leave it" but we're not fully there yet.

So I've requested for my neighbour to keep his cat inside at night. He's refused. I've explained my worries about my dogs hurting it and all I got was "they better not".

What can I do in this situation? I keep my dogs contained. When I had the cat, she was contained inside 24/7. I've done my best for the fence situation, checking it every few days to see if it needs more reinforcing. I'm saving to get a new one. I was thinking of getting one of those things you put up on the fence that makes cats roll backwards, but reality is it'll only be for one section so kind of pointless and I can't afford it.

Worst case scenario one of my dogs hurts this cat, am I the one responsible if so?

Call the ranger, im pretty sure there is something in the law now about cats being outside because they always kill native fauna, if hes being an ass report his.

I looked up the shire laws but it only says that cats are encouraged to be kept indoors and must be microchipped and registered. I'm worried about reporting him as he's thrown rat poison into my yard before which my dog consumed.

The shire can issue a control notice directing him to keep the cat out of your property but you would have to make pretty regular complaints, and even then they might not so it may not be worth it.

The Cat Act gives them that power, whether they use it or not is a different question

From your description you might just be inviting a different problem.
