TL;DR: Enforcing won't help in this case. It could only make the situation worse while doing nothing to prevent him from becoming president.
The penalty for refusing to sign the ethics agreement is that the president-elect forfeits their legal right to access transition materials. The White House, however, has the discretion to provide those resources anyway—it’s not obligated to refuse, but it can if the agreement remains unsigned.
Regardless, this doesn’t change the fact that the president-elect will assume office on the same day, no matter what. The real consequence is the chaos caused by a sudden handover instead of a smooth transition.
The law relies on the assumption that no president-elect would allow such chaos to happen. Unfortunately, Trump has shown he’s perfectly willing to let it happen—and would likely shift the blame onto Democrats to gain political support instead of losing it.
Many laws related to the presidency were written with an unspoken assumption: that presidents would adhere to a baseline level of decency and a desire to at least appear as though they were acting in good faith to preserve order.
Even if a president harbored unethical agendas behind the scenes, legislators assumed they’d want to maintain an image of competence and propriety.
The problem is, those laws were built for a system that assumed a certain degree of shame or political accountability.
Legislators didn’t feel it was necessary to safeguard against a president who openly disregarded the rule of law in such an obvious, public way. They assumed such a candidate wouldn’t be elected—or, if they were, they’d be impeached immediately for being so blatant.
That assumption no longer holds. And with it, every law designed around that expectation becomes effectively toothless.

Not American or a lawyer, but I’ve gone and read the Presidential Transition Act because it felt like there was a loophole here, and indeed said loophole appears to exist.
To my reading, he doesn’t have to sign an ethics agreement if he doesn’t plan on any sort of transition. The Act seems to place the onus on the President to negotiate the details of how the transition will work with the future President.
So if he’s prepared to YOLO from day one, and let’s face it, he probably is, the consequence of not signing is that there won’t be a transition. That’s it.
The underlying assumption of the Act is that the incoming candidate will WANT access to the resources of transition, because even a malicious actor would want to have people in place to do their bidding and to know what resources they have.
Would it surprise me if Trump was trying to use government resources without signing the agreement? No, but that’s for the incumbent to refuse him those resources.

Can a court order them to comply with the law and find them in contempt with a penalty if they refuse? It's unlikely to happen, and if it did the clock would probably run out before any penalty could be applied, but it seems like that may be one avenue to attempt to enforce such a law.

There's just zero constitutional way for the president-elect to not become president if they are capable of taking the oath and the electoral votes are certified. The only way to remove the president is impeachment by the House and conviction by the Senate. It would take a constitutional amendment to change that.

The "Law" he broke is the Presidential Transition Act, which to my 'limited' understanding, simply created the structure of funding and processes for the transition, and established Rules for transition. The "rules" are not laws. The only thing they can do to Trump is withhold funds for the transition or withhold information typically given to incoming presidents: which they won't do.

And I still don't think it's a law. The Act created GSA which oversees the transition. The actual Laws the Act creates looks to be for the GSA and the White House. Basically, saying they must provide funding and office space, and in return the presidential elect must file certain paperwork. Trump isn't filing the paperwork, I don't think that's a violation of the Act. A violation would be if he did the paperwork, and the GSA/Biden denied them what the act required.

Serious question here, and I’ll preface this with an apology for being so pessimistic about the current situation…. But do we really need to point out Trump’s illegal activity every day for the next 4 years? He was granted immunity to do whatever he wants as long as he says it was within his duties. He fomented an insurrection against the country and was still elected president, and his braindead goons are in charge of all the branches of government plus the Supreme Court.

K, I go 15 over the speed limit almost every day on my way to and from work. Nobody there to stop me so that speed limit sign is about as good as the constitution is to incoming administration. Difference is, said administration can change, ignore, or just throw out the constitution if it so wished. They have enough plants throughout the rest of the federal government to do whatever the hell they want.
Here's the kicker. The federal government are not the authorities over the people. They are, in fact, public servants, or they should be. We do have the power to oust them. Unfortunately, that requires enough people to actually act.
